Design and development of business applications using C++, JAVA as front end
tools and ORACLE as back end repository on WINDOWS platform. Modify
software or customize software for clients'use with the aim of optimizing
operational efficiency.
Education required: bachelor degree in computer science, engineering,
electronics or related field. Experience required: 9 months as Software
Engineer.
Any idea what Onet code the above description falls under?
I am planning to take up Java developer position with new employer using EAD. is it ok? Lawyer has been saying that the job description has to match 100%. I dont agree with him. any comments please?.

I would say - those having issues must all get together and write to the Authorities asking them to update rules on website and not arbitrary.

I never said 80,000 FB visas are reserved for EB. Then those numbers would not be called as FB visas, would they?
Any way, if you look at the statistics (page 52, http://www.dhs.gov/xlibrary/assets/CISOMB_Annual_Report_2007.pdf), USCIS has not fully utilized all available EB visas for 12 years out of the 15 years. Hence I said, USCIS is THE bottleneck. For the 3 years (out of the total of 15 years), unavailability of visa numbers is THE issue. But for the majority of the years, lack of visa numbers is NOT the issue.

Now I assume there are 10,650 visas per country available from October 1, 2006; why the hell have priority dates for EB3 India moved by only 3 weeks? This is absolutely ridiculous.

You need to file form 4852. That is super easy and I have filed it once.
There are no problems with that whatsoever.
You employer cannot pull a single hairstring from your head. So do not worry about the legal notice. That is all bull. He is probably worrying day and night about the DOL complaint you made.
What you need to, further, is go to the local IRS office and talk to one of the employee about not getting your W-2. Not providing a W-2 is serious issue.

I too like everyone else on this board am in this seemingly endless EB queue (6th year in the GC wait). I was just trying to send a message to folks out there that carve your life based on what you want to do, and if you can do what you want to do, just take it a bit easy and don't miss out on the fun things in life while this wait persists.
I have gotten to the 2 houses and 2 jobs all the time while being on a H1 is because I never put my life on hold because of the GC wait. Just had faith in my qualifications and skills, and the confidence to be able to find a H1 job in case of a job loss.
Sure enough, I had a job loss last year and here I am - back on my feet in 2 months - found another H1 job and am making more money than the previous job. Only thing, is my PD got reset and the wait will get even longer...it is still not going to stop me from moving forward...I have more plans for the next 2 years including possibly starting a business with a US citizen partner. Am currently looking into the possibility of filing a 3rd concurrent H1 for that.
Moral of the story, don't put your life on hold because of the GC wait....GC is not in our hands...why worry so much about something on which we have very little control over. Too bad, this government doesn't care about this massive highly skilled workforce and are treating us so bad. That shouldn't stop us from living life at our terms (for the most part of it).
What we can control is our destiny and as long as we worry about that and give that a proper direction...GC or no GC...doesn't matter so much..

Reality is DREAM act is directly connected to HISPANIC votes for Democrats, EB community doesnt have any VOTING rights, neither they get any support from the folks who are already GC/UScitizenship holders.
Once people are out of this GC mess, they all start talking about anti immigration and that's the reality, u go to any indian community around and see how much support you have from those folks who have GC/US citizenship.

Green card holders do not even want to be friends with H1B.

What does such a response mean?
To me, it is evident that IF the action is clearly defined AND some one has a clear mandate, then people will come together to participate and contribute.
I am tired of hearing how the loopholes in the immigration system are taken advantage of. If we focus on increasing the cap for Indian EB category [across the board] and recapturing the lost visa numbers, then the remaining problems will take care of themselves. For this, we need to lobby until we get a reform legislation to pass.
And for people that are furious that a very small percentage of folks are taking advantage of the system, i urge them to look at the majority of the people that are leading a honest life and take solace. You are not alone in this journey. And don't let lack of GC put a damper on whatever you wish to do. Get creative and make use of the same legal system to achieve what you want. You are in the same framework as those folks that are taking advantage of the system are. Work the system in the right way.
I have neither met a honest person that has ultimately lost nor a dishonest person that has ultimately won. Please have some self-confidence and self-respect and keep fighting for what we truly believe in. When you hit a low point share your experiences with others here - in a productive manner.

There were times when I was really depressed, specially when I got delayed in New Delhi with "Name clearance" for H-1 renew. However, I believed in higher power and never lost hope. My parents (mother US citizen,father GC) always kept my spirits high. I also got a lot of support at my job (when I got stuck in India, my chief pulled all strings possible to get me cleared).
I also had a backup plan, where I could go to Canada or worst, can go back to India where I have an established practice.
Botomline, do not loose hope and work hard.
