please stop attacking for no good reason. i've been through this whole set of emotions too, and i'm pasting below a dialogue with Greg Siskind on his blog. Greg is a much respected figure in immigration law and does his bit and more to support our cause. please read it, he makes very valid points.
why are these kids our enemies anyway? they are stuck in a bad position and helping them get relief behoves us.
Paskal - The children of legal immigration applicants were specifically covered in the Child Status Protection Act passed earlier in this decade. They are now allowed to immigrate with their parents even if they turn 21 during the middle of the process, a key change designed to ensure that those here for years waiting on green cards could still benefit. There were other important benefits in this bill. read from the bottom up...
But on a separate note, strategically we saw what happened with CIR when we tried to get every fix on one bill. Three years of work down the drain. We need to get each fix done a little at a time and take what we can get each time and focus on getting more in the next battle. One week we have a victory for illegal immigrants. The next we win one for skilled workers. The next we help refugees and asylees. We need to cheer each victory rather than be upset that not every group was helped.

I do not think people really oppose the relief being offered. Neither do they grudge the proccess of legalization for undocumented immigrants. However there is a great deal of heartburn over the way skilled workers are treated. Why can't this bill include legal children who have lived here most of their lives? kids have to "become illegal" to get benefits? what's the message?
Similarly in CIR, 90,000 GC a year for 5 years were offered for backlog reduction. Compare this to the almost 1 million FB relief and the 11 million GCs for legalization. what's more no one knows how many undocumented workerers there are. 11 or 13 million? so 2 million extra GC are just an asteriek to congress, and yet they won't give paltry increases to skilled workers to cover the backlogs?
this is the source of frustration that's manifesting in the comments you are reading.

Some have commented noting that DREAM might pass because it's advocates are showing passion. This should hopefully inspire you rather than upset you. Immigrants Voice has really given me hope that the skilled worker community finally is starting to find the passion that will change minds in Washington. To date, this community has largely depended on the advocacy efforts of groups like AILA and the ITAA rather than on the grass roots efforts of the community itself. These groups do a great job, but they can do so much more in partnership with an active immigrant community.

My wife's AP was approved today. The receipt date on the original filing was Jun1st.
Since, we had to visit Canada shortly for a conference, we took the invitation letter to the InfoPass appointment. The person at the counter asked us the fax the documents to the Nebraska office and we did that the very same day.
After a week, we received an approval email.
I also had contacted the CSC around 20 days before the infopass appointment, even though I chose the 45 day options while booking the appointment.
Hope this information helps others.

I will like to ask your brain if this could be a problem as i did my H1 B Transfer twice before appling for my I 485 and everything went sucessful my GC sponsering Company is not in good terms they might have even revoke my I 140.
Is there any way to find out if my I 140 was revoked.

That may be true if you are not a AZ resident.
If you are an AZ resident, a AZ driver license is enough to prove your legal presence in the US. This is expressly stated in the Bill.
Be prepared to carry your H1B papers/EAD cards/I485 application papers and wait like a criminal while the cops check if you are legal or not after stopping you at the Phoenix Airport terminal, when you are waiting for your connecting flight, since your skin color was not white and you could be a potential illegal.
Also, be prepared for this to happen to your kids even though they might be US citizens.

I am planning to utilize AC21. My PD is OCT 2005, EB2 India, I-140 was approved in June 2006 and I-485 filed on 2nd July 2007.

The disadvantage of not filing for AC21 is if your AoS is approved with USCIS believing that you will be working for the original petitioner after approval.
That is the disadvantage. USCIS will not know that you intended to port to new employer by invoking AC21 and come the time your apply for Naturalization, USCIS will discover it and may suspect you of fraud.

Copanies like INFOSYS are not the culprits. This is going tangenatially. It is the local small desi body shops that suck blood and hold candidates life in their hand because of GC. They should be investigated.
I think they have to pay the minimum wage as declared in their petition.
But I doubt whether they even send those employees on assignments. I guess they process these H1s as a carrot to retain the employees or to preprepared for any future assignments (they may not even come and the visas are never used)...
Wish there is a different category of visas for outsourced kind of work so that H1s can be used by America based companies and H1 is not seen in such a bad light.

My law-firm/company did a good job of declaring a generic (still O*net compliant) job title/description which luckily encompasses the range of roles (compliant with the job description) I have been doing over the last 8 years. And if required, at this point, I am at a stage where I am willing to take a demotion or something if required to work on the job role that matches the GC temporarily, if thats what it takes. And I am sure my company will fully support me. There is no dearth of requirement for fresh coders/developers at our team/company. They would probably be happy to oblige :D . But I hope it doesn't come to that. I think there is some leniency allowed in the growth of job scope/promotion etc over the course of years it takes to get the GC. Gurus any comments ?

- some clarification about overall H1B status or something across all these years (although I know for sure my H1B status, I-94 etc has been perfectly clean so far)

- Medical checkups may have expired and they need new ones? (my medical reports are from June 2007)

Here are the words quoted from the RFE letter
You must submit a currently dated letter from your intended permanent employer, describing your present job duties and position in the organization, your proffered position (if different from your current one), the date you began employment and the offered salary or wage. This letter should be in the original and signed by an executive or officer of the organization who is authorized to make or confirm an offer of permanent employment. The letter must also indicate whether the terms and conditions of your employment-based visa petition (or labor certification) continue to exist.
So, couple of questions to the gurus.
a) What happens if current job title & duties are different from that of the proffered position? I am with the same employer since the beginning. How much of an allowance/leeway is given for growth of job role/scope?
b) What happens if there has been around $25k increase in pay from that mentioned for the proffered position? Is that an issue?

it probably means.. they are opening each and every mail they have recived and checking if the docs are in order or not..if they are.. they file it...else they send an RFE...
i dont understand..how someone can be so f@#$% dumb as not know this simple procdure..
there are so many posts..i got a LUD what not.... its annoying...
its like.. USCIS touched my lu(n)d..will i get a GC now..
