This whole GC system is so unfavorably tilted and discriminatory towards Indians its unbelievable.
I also think its very unfair. I being EB3 India with PD of August 2001 is stuck whereas someone in my same category who is EB3 World who filed 2 yrs later than me is now elig to get greencard.

You can only use experience IF it is for EB3 AND EVEN THEN ONLY IF it so states on the labor certificate.
However, I have seen a few that have slid by the adjudicators. But the chances are very very slim and I have seen cases picked up later on if it was incorrectly approved ... but not always.
I'm certain you cannot do that. While applying for H1B Visa, you can use experience in lieu of education, but while Perm/I140, they consider only 1 degree. Either its Masters or its Bachelors...even both of them are not considered as aggregates.

Regardless of the incorrect forum to tell about yourself, your story has serious flaws.
you are just telling us your side of a photoshopped story.
Even after you are here illegally, you can correct things and take a legal turn. there are so many cases where people who have overstayed or crossed over illegally, got themselves deported and or brought themselves out of the closet and applied and got their citizenships.
Also, bcos you spent 30 years in the country, you should be given a priority over a kid from your country who kept applying for a green card lottery every year, trying to enter the US legally?
to make matters worse, you stayed illegally in a country and did not follow the rule of law.
1. I am beyond the �waiting for my delayed Green-Card� and �attempting to correct my ilegal status� stage. I am not new to immigration, I�m true to immigration.
2. I am no longer fighting for my rights. I�m OK. I�m in my own country with all rights available to me and am offered a Waiver by the U.S. to visit my friends, family and loved ones when I want. Today I�m fighting for my USC Immediate Relatives� rights from my country. How many of you high&mighty can say that? Probably never will too. You�d have to walk in my shoes and from my view none of you except for 24ps can fit them, though sledge_hammer might have to learn how to walk in them. He/she sounds a lot like me in my smug and cocky drug peddling and trafficking days. Clue, sledge_hammer: The key to expertise does not lie in what you do but in how you do it. Obligating an unrequested personal opini�n on someone is quite negligent and incompetent of a professional. But I guess that�s what�s expected of IV while you�re dug in here, hunh? How unfortunate.

Option-1: Become Illegal and get a Z visa.
Options-2: Go back to home land and live with dignity and peace of mind. (This is the option I would take). I am thankfully to the congress for helping me to make a decision, rather then wait for life time.
Options-3: Re-apply in merit based system and wait in line for 4 to 5 years, until some other similar bill comes and says you to restart again in some other system.

Pls do not lose heart.
speaking for myself, i have tried to remain active, but suddenly got swamped with a huge work-load.
in this economy, performance is a matter of survival. Not to say that we should accept immigration to be a luxury.
It is a pity i had to miss the donor's telecon last week, simply as i was still working.
So bottom line: there are still people who are willing to participate and active, but it is a matter of immediate priorities.
Let us keep up the spirit and keep working....

How did you people know it is gone to CSC? Did you call CSC to find out or did they send you some kind of letter indicating they have transferred your applications from CSC to NSC??

(d) Form I-140 Petition Must be Approved Prior to a Favorable Determination of a �106(c) AC21 portability request.
this could be read 2 ways...either you need have an approved I-140 prior to filing for portability OR the adjudicator needs to approve the I-140 prior to determining portability.
I had asked TWO different lawyers and they were BOTH 100% sure that to use the AC-21 you needed an APPROVED I-140 not an approvable I-140.

Hello Guys,
I am planning to utilize AC21. My PD is OCT 2005, EB2 India, I-140 was approved in June 2006 and I-485 filed on 2nd July 2007.
The question I have is if my current employer can do anything, I mean anything at all, now?

Not everyone who filed on July 2nd has the same receipt date.
Pls check your RD for when your 180 day period ends.

I just got my EAD yesterday (with 1 year validity even though PD is not current). My company lawyer will contact USCIS about this, will update once I have any info.
Received only one year EAD .I will have to call USCIS for incorrect validity date of issued EAD.

My Infopass appt. is next week in baltimore. My EAD & AP are still pending for both me and my wife. 90 days was y'day.! USCIS recd. our EAD & AP applications on 8/7.
I have scheduled my appt. for tuesday morning. I could provide only my info (A# and receipt #) online - can i take my wife along too although she hasn't officially scheduled a appt for tuesday with me.? Do you know if they may object when we have filled ii only 1 person online but 2 show up for the appt.?

I think you should not face any problem. I went alongwith my wife (Although I took appintmnet for 4 but my children did not come for obvious reason - school day) and Guard, Guy at window or lady at the counter none of them asked a single question to my wife. So I believe if your wife come alongwith during an appintment, you should not face any problem. All in all for me total process was not more than 30 -40 minutes. So in case if they hesitate to let her in she can wait outside either in a car or in waiting room (Assuming Baltimore has same facility as Dallas)

The way I look at it is - Loo is a target we must aim. CNN will definitely change its course and path it is taking if we start exposing Loo Dog. Once truth comes out, CNN may be worried about hurting its image and will definitely change courses.

Dose any one care for people who have been deported and had a green card,,,,, their wife,kids,mom,dad,brother,sister, every one are in us,
