We have been calling and talking to ppl all over new england area.
But we have hardly been able to get a convincing number of ppl to attend the rally.
Have you watched the bus thread for New England Area. 26 votes, can you believe that.
We definitely need to get more innovative. I dont know what ppl want, so they can be motivated.
Sometimes i think being educated is a curse, as ppl become more scared and are fine adapting to the system.
Look at the ILLEGALS at least they came out openly. They dared to come forward and i am sure they will be rewarded sooner.
LEGAL ppl who have nothing to fear are then also they are more scared to do anything. So this is the right time for me to express my opinion LEGALS ARE FOOLS.

I think they have to pay the minimum wage as declared in their petition.
But I doubt whether they even send those employees on assignments. I guess they process these H1s as a carrot to retain the employees or to preprepared for any future assignments (they may not even come and the visas are never used)...
Wish there is a different category of visas for outsourced kind of work so that H1s can be used by America based companies and H1 is not seen in such a bad light.
Having a different category of visa sure sounds good.
However, it would be really difficult to implement as these BIG consulting cos will easily show proof that not all deputed in US are responsible for offshoring the work.
Another point would be that these cos charge a very high billing rate for those deputed in US and the clients (US companies, who hire these consulting cos) usually end up paying the same rate (or even more). However, the poor employees get probably just 50-60% of their billing rate.
I do have a regard for these cos, they have changed the landscape of our indian economy, but they have exploited their employees to the hilt.

There is a question about removing per country limit at the end.These morons are very concerned that no single country (meaning China and India) overwhelm the supply of immigrant visa's. I wonder if they will consider applying country limits when passing amnesty :D

Because, till 2005 there were extra 100,000 (total 242,000 were issued) recapturd numbers available. Therefore, no one cared (DOS/USCIS) about AC21 law that removes country quota. EB2 were curren for all then.

I left my previous employer more than 6 months back , he didnt paid me my final paycheck and i complained to DOL since 3 months...now wehn i asked for my W2 he said me to do whatever i feel and he is adamant at not giving it....moreover he said that his company has suffered losses worth 25K and his lawyer has sent a legal notice in this regard....and when i said how will we file taxes he says he wished for me to be out of status and go back.....
Since i have complained to DOL and also it is more than 6 moths since i left his organisation giving proper notice and have email confirmations, can he issue me legeal notice.....?please advice...
He is also saying that he has written to USCIS that I am fraud,....though I have been working in fortune 100 companies and now also working in reputed company and never lied for anything and was on project from day 1 since I came to States....? can USCIS cause problems for me in future...
Also, he seems to have closed his company..
Folks please advice....
Keep all email correspondences....You can infact make him pay dearly for harasement...

I am not totally sure but this is how my husband earns his pdus..he is a volunteer in the local PMI chapter and he also presents some Project management papers. Also the local Chapter will have some monthly meetings or networking meetings where you can earn PDUs. He is also teaching PMI classes through the chapter. All these without any costs. So find a local chapter in your city and that should help you.

my travel date is on nov 21st and my RD for ap renewal is aug 6th. here are the things I have done so far.
1) called NSC and expedited mine and my spouse AP.
2) sent a fax copy of the expedite request letter to NEbraska service center requesting an expedite.
3) have sent all the documents to the local congressman and they are sending a letter by fax to NSC requesting to expedite.
4) Have an infopass appt for oct 28th.
5) sent another copy of the ap renewal receipt, along with 2 phographs, 485 and i140 receipt copy along with a letter requesting expedite with an email from travel agent citing financial loss if i cancel tickets.
6) also, my father in law had to undergo a bypass surgery (emergency) this week and we have received a letter from the doctor regarding the same and will be using it during the infopass if I do not see an approval (atleast online) before our infopass appointment.
Mine RD: Sep 3rd
I have booked tickets for Nov 18th.
I think I can wait until this month end to start expediting process. I will have 17 days window.
What do you suggest guys? Is that a reasonable time or I should start right away?

As you might have guessed, I am on the EB3 bandwagon because of circumstances that were beyond my control [The filing attorney screwed up :( ]
At the time of my EB3 filing (Feb. 2004) I did possess a Masters degree and more than 5 years of Work Experience and the job responsibility that my petition was filed for, did require a Senior worker with Masters experience. Unfortunately, things didn't go that way and here I am.
I keep reading about some lucky souls [god bless their souls :) ] who have managed to retain their priority dates and converted to EB2.
I really want to do that. I am not sure where to start.
1. I used AC21 and took up a new job recently. Do I approach my new employer and talk to them to see whether they would be able to file my petition in EB2 category? The bad thing is, when I joined them, I told them I don't need any sponsorship or assistance from them. It would be a volte face to go back to them and request them to do something. And the best part is, there is no guarantee that my company would file my petition.

It is best to not to change to an employer offering you anything less than the wage rate specified in the GC labor certification. On the higher side, it is better not to take up a job that offers more than 4% more salary of that specified in the GC labor certification. It is hard to resist 20-30K higher salary, but one would have to resist the temptation for taking the job offering higher salary. Otherwise, there is a risk of USCIS denying the GC application.
USCIS doesn�t account for dollar appreciation or devaluation. USCIS also doesn�t account for annual inflation when calculating the wage rate. So even if your labor certification was applied in 2003, you still have to continue at the job with the salary specified in the GC labor certification. If GC application takes another 5-7 years, then you have to continue with the salary specified in GC labor certification application.

A freind of mine came across a gentleman, who is here on work visa and he is facing a unique problem. He is married to two persons and wants to bring his whole family here in the USA.
