ramus, follow my posts in the past 20 days and you will see i have posted many posts for this AP expedite. I have a travel coming up shortly and I had only exactly 90 days from the date of application and date of travel. My application was approved recently along with my spouse. There is even a post where I listed out all the steps I took to expedite and finally finally only the local congressman phone to USCIS helped. its just unbelievable, but its possible. I have tickets that even if you postpone the journey I will lose money. I said to myself enough we lose with USCIS, and so decided to take all and any steps to expedite and get it done. just follow my posts (like start reading my past 20 posts) and I am sure you will find it useful. We can get a employment verification letter. But now a days you need employment verification letter for many things. Just recently, jan 2009, I carried EVL for visa stamping. Now, my DL is expiring, should I ask them again for EVL. It has become more like HR nightmare for having a non-immigrants in the copany. These taylor made rules are not appropriate. When driving is a basic necassity, I could not comprahend why they need all additional documents. Any ways if this is true I have to ask my HR again to provide me one. Hope they do not get mad at me.
Can't agree more. This is nothing but harassment. What has drivers license got to do with employment or immigration status ?

Did you get an RFE before denial?
Could you please post who did the education evaluation for you? Was it a course by course eval?
It will also help if you could provide details on your labor certification category such as
section (203) (3) (i) or (ii) etc.. for skilled worker or professional. I believe You could also find this on your I-140 receipt notice..
'Will accept academic studies evaluated as equivalent of US Bachelors' This wording is tough to handle given that what you have is a Combination of courses evaluated as equivalent to US Bachelors, based on details provided in your post quote "I have a 3 year diploma & 1 year towards Bachelors in business" end quote.

I am asking this question in this thread as i dont know how to start new thread.

My spouse's employer had applied for H1 this year and he got a receipt number. But the check has not been encashed. Now when I checked the status in website it says the following:

Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case Rejected because of Incorrect Fee
On April 30, 2008, we determined that this I129 PETITION FOR A NONIMMIGRANT WORKER was not properly filed because you submitted incorrect fee. Therefore, we have rejected your case and returned it to you with all supporting materials, along with the fee. Please follow the instructions on the notice to submit the case with correct fee.

Employer is yet to get the documents back. He checked his records and says there is no mistake from their side including fee...
The question here is:
1. what does case rejection means? - Is it end of it or can it be reapplied with correct fee/ other supporting docs, it at all thats the case

since the new supplemental memo has been issued, the rule making agenda may be pushed off. but i think the new memo will be effective immediately.

1) Please update your profile.
2) It's sad that we are getting GCs at the expense of people of came here illegally. Our efforts are held hostage by both parties (It's simple), One party wants to win votes of one group and the other wants to wins votes as well of a different group. It's not about "DOING THE RIGHT THING". If it was about "DOING THE RIGHT THING" there would never had been a backlog. Backlog elimination center was created just to put some cases on hold and clear cases of 245i applicants (USCIS will never allow us access to that data)
3) DOING THE RIGHT THING....why unequal penalties of the parties who break the immigration Law. All punishment is directed towards the employee. EMployer only gets fine. Make punishment stricter for employers, (hit them where it hurts most, jail them and shut down their business)there will never be any illegal immigrant getting jobs. there whould be equal punishment for both.
4) Why this doble standard when it comes to immigration. why don't people oppose when jobs are transferred in name of outsroucing or shifting production to cheapr countries? Anti Immigants are biggest Hypocrites ever and Pro immigrants are not representins immigrants properly. No one focuses on the injsutice done to legal aliens.
5) I am EB3, I followed Law, I am in backlog because Govt did not process the cases in 2001 , 2002, 2003 in time and created a backlog and I resisted the temptation to break laws and buy Labor substitution AND I openly say that I oppsoe illegal immigration and amesty to illegeal immigrants (and I do feel sorry for them. god bless them they deserve a better life).
I am one of those who need Immigration reform immediately. Justice delayed is jsutice denied (rest is all face saving).

Ok, I've seen a lot of threads about go to the rally, actions items, I've reading a lot of guys saying dont ask for your receipt status, dont waste your time etc, etc.
Yes we did the rally we were great with all those signs, and appearing in the Indy TV but...
Question remains open:
1. When are they going to increase the GC quota?
2. When congress id going to do something?
I've the feeling that that's it we made our point but we are still with no GC, waiting receipts..............

I know before you start blaming me for this thread, as it is of no use, I would like to point out that most of you must be experiencing the same thing. I didn't care much for Visa bulletin until it became current for EB2 two weeks back. As the time progress, I am doing all sorts of things, like checking USCIS case status, and checking everything that can possibly give me some information. I know that it is waste of time, I know it is not good for health, I know that I will get GC when time comes, but still, my mind is tricking me to think about it. I checked all these forums until 2A.M last night. I am not having enough sleep. I am waiting for a opportunity to get rid of my desi employer. I am really getting frustrated (I am not saying that I have been waiting for GC approval desperately). I just want to share my frustration and what I have been going through. I know I am in a better position than most of other people whose priority date is not even current. I wish they never dangled a carrot in front of me. I am not sure if they disappoint me next month, but I am still keeping my hopes. Hopefully, I would get over this and have enough sleep from today.

Hi,
I am planning to accept an offer from a company that will also sponsor my H1. All the terms & conditions look fine to me and their seems to be no bond.
However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.
"Employee acknowledges that the Company may invest significant sums to train and educate Employee and the Company�s investment in Employee would be jeopardized if Employee were to leave the company�s employment prior to the Company�s receipt of the benefits of such training and education. Employee hereby agrees to refund to the Company all amounts expended by the Company in the immediately preceding 12 months for education or training of the Employee if Employee resigns from the employment with the Company or is terminated by the Company for gross neglect of duty, material breach of the Letter or this Agreement or conviction or plea of guilty or no contests to a felony. Employee authorizes the Company to deduct and withhold such payment in full from any compensation or other amounts otherwise owed or payable to Employee. The payments will be due within 30 days of
termination of the employment."
In my company if they transfer you with-in company and pay all moving which can total to 25-30 k, they say that if you leave with-in 12 month of moving you have to pay back moving expenses. If company terminate you before 12 months, they will move you back and pay for your expenses.
It may be a standard clause if it is only valid for first 12 month. May be they spend $$$$$ on training but i am pretty sure they'll have hard time enforcing it.

i would recommend the following strategy:
1. file a case of harrassment with the state DOL / agency.
2. contact an immig attorney and have them 'on your side'
3. contact the IRS via registered mail and document your case, with FACTS, not OPINIONS or EMOTIONS. send a copy of the IRS letter to the State DOL.
4. further, file a complaint with the DOJ (if applicable). check out their Website.
5. finally, send a 30 day demand note (if applicable in your state) stating YOUR demands against the former employer, asking for immediate cessation of all activities which can be considered as coercive, amounting to emotional stress and harrassment. if possible, get a Doctor's medical advice and keep that on record.
6. eventually, think about getting a lawyer to do this case 'pro bono' . some might do if you can get good local press about thsi case and effectively 'market the lawyers costlessly'. of course, all privacy goes out of the window.

1) Life Insurance ... AIG refuses to give me the quot for 30 years (Ready to give me a 20 year term life quot) term life insurance knowing I am on work visa, US GC is in process (Though I did not mention that I am Canadian permanent immigrant). AAA issued me a policy that is 20 years not 30 years (Simply refused) when I gave the proof of Canadian permanent immigration and US GC filing. This is most current experience.
2) After 2001 bubble burst many credit unions stopped taking H1B visa holders as member. I do not know the current practice.
3) I think in illinoi, I have heard that H4 people can't get driving licence simply as they do not have social security. Now legally H4 can not have social security and thus no driving license. ITIN would not be considered for driving license. This story I also heard a while back. I do not know about current situation.
4) In job, you can not have promotion, salary increment (Though Accounting workarounds ultimately can provide you what you want from the company).
5) 401 K investment can become risky if you will have to go out of uSA permanently in a sense of 10 % penalty for early withdraw. Ya, Somebody can say that then do not withdraw. In that case, managing it would be hell by sitting thousands of miles away from US.
6) You can not invest in Educational investments schemes ( Theoratically you can invest and they will take your money gladly) as those are ONE-WAY money, once gone you can not take out, only your children can take out. Now imagine you are on H1.. Invetsed money in eduction schemes for your children. Down the road after 10 years suddenly finding yourself in limbo you go back to your country... money is stuck.. The govt. authorities in Bangalore never gave my PF, citing some
spelling mistake in my fathers name. Guess if i showel down 10% bribe
in their throat , they might give. Later i didn't bother to pester them,
i am here. The babus also might think "This chap is in USA , minting $$$".
I can attest to that. It's not unusual to have to pay bribe from 10-25% to get the PPF money. And even that takes weeks/months to complete. I've personally known relatives in India who had to do that. It's not even considered anything out of ordinary there. Good Luck R2I's.

I can attest to that. It's not unusual to have to pay bribe from 10-25% to get the PPF money. And even that takes weeks/months to complete. I've personally known relatives in India who had to do that. It's not even considered anything out of ordinary there. Good Luck R2I's.

I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...
Could someone please tell me -
What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.
I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....
(1) Reversal of July 2007 bulletin
(2) Two year EAD AP
(3) Currently working on Same similar job ( AC 21).
(4) Push USCIS and DOS to publish data.
