    However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.


    No problem these bonds etc clauses are unenforcable in court and
    only act as deterrant against people leaving. Its a dog that barks not bites.
    So you can sign and start working. Even teh good consultant have these types of clauses.

    Contact attoreny ASAP why/how it has happened. As he represnts you, USCIS acts upon his request to withdraw. However, he has to make such requsest only upon your written communication to withdraw the application. Therefore, find out whose mistake it is (law firm or USCIS).

    Thanks for all your responses, It is clearly the attorneys fault.
    - I have a letter I wrote to the attorney asking them to withdraw the representation. and the letter clearly states that.
    - I have a copy of the letter the attorney sent to USCIS and this letter is clearly asking USCIS to withdraw the case.
    The error is with the Attorney and it is one of the big immigration firms.

    What really bothers me is that the error is not on USCIS's part but the error is of the Attorney so I am afraid that USCIS may not be too inclined to reinstate the case.
    Does any one know if the client has any legal protection from errors and mistakes made by the attorneys

    current count 260.Great job everyone.I was chatting with few friends casually and mentioned this. Four of them also have voted. If we can hit 300 by end of the day today, that will be pretty impressive. As someone said, even though this might seem very insignificant but spending 3-4 minutes is definitely not going to hurt us.

    Hi All,

    Sorry to bring this thread back.

    See, what IV few members have written. I found them again in user control panel along with RED dots. I stopped caring about RED dots.

    But, there are some comments that really hurts.

    These are the comments few IV members wrote about my posting while giving a RED dot. Though I stopped caring about RED/Green's

    One must behave like a civilized person. We came here with atleast Bachelors Degree. Some of them with Master Degree / PhD's. Majority of us are educated and know how to behave with people.

    Do you know , how it hurts some one?. Are they doing in Green Card frustration? or Are they doing it wanted?.

    JaiHind....would you mind briefing me on your casez? why did ur employer charge 7K from you? did u also sign similar contract?

    After reading all the great posts on this thread and their experiences, it hurts me why in the world did I even pay my old employer 7K...(I wish, to do something thing like this and check with great experts opinions like how you did on your case....) and could have saved 7K:mad:

    here is my experience and for sure you all would agree by not paying 7k to this 2nd employer "sky wouldn't have fell down"....:

    In 2003, I joined my 2nd employer (Indian Consulting) since I came to US in year 2001. At the time of joining this employer made me sign all kinds of contract and one of the contact that I signed was to pay (50-50%) for GC processing and if left the company before GC is approved I have to pay the remaining 50% and contract was something like this "if Employee were to leave the company’s employment prior to GC approval, employee hereby agrees to refund all expenses includes attorney, processing fees etc., to the Company with 30 day's......."

    Here is my GC experience: I provided all the information that my 2nd employer/attorney requested in order to file my GC and after 6 months on my follow-up on where they are with GC process they told me to provide additional paper work due to which they could not start my GC processing "6 months wasted here" (since I am idiot) and should have realized this employer is a useless/fraud one and didn't learn my lesson in my 2nd attempt of GC processing with this 2nd employer (something similar happened to me with earlier employer (Indian consulting) & by the time I realized it was already 2 years wasted down the road and they haven't started my GC, I got irritated & left my 1st employer "2 years wasted 2001-2003).. I could have left little early but they had close to 40K of my overflow money with them which I was able to extract at the time of my wedding excuse....thank god!!

    Now after providing other documents that he requested papers and then after then every month I used to follow-up but after another 6 months I know there was no progress and this employer is just carries about money and one day I asked him if they have any intentions of applying for my GC or would like to continue on playing around this catch up game for ever and finally they gave me attorney contact number & work directly with him...this attorney is another JOKER (Indian guy with a fake American accent). This attorney thinks he is Mr.George Bush-2, I could never talk to him directly & his assistant used to put me on to his voice mail every time when I called & later he used to mail with response...

    By now I have already paid my 3.5K (that was forcibly deducted from my paycheck in addition to thei 60% of hourly pay cut) and almost 23 months gone down the road and asked if they filed my GC that was end of year 2004 and guess what.... they don't have receipt number at that time too...and right then I gave my 2 weeks notice and in advance I applied to another known consulting company H1 transfer (this is my current employer who is good and no complaints). The minute I gave my resignation, I was still working at the client using new H1 and happen to know that this 2nd employer was enjoying 60% of my hourly billing rate and when I gave my resignation they HR was bargaining me for increase in my pay by 50 CENTS/hour (can you guys believe this and its true they did that to me "50cents") and non of their great offers worked on my end and!! I left the company once I got approval from new employer and next day they sent me a notice to pay remaining 3.5K followed with legal action notice that will be taken if not paid in 30 days of time frame else they will give information to collection agencies...) Since they mentioned about "collection" agencies I decided to pay the remaining amount else as you all know these collections agencies can also ruin "credit history"...& thought its not worth dealing with credit history.

    Summary of my GC experience: wasted 4 years of valuable time (2001-2004) & most important paid 7K for GC in first place process didn't even start at all....isn't that a JOKE!!

    my 3rd employer filed for my GC in MAY 2005 in EB2 (TSC), received EAD/AP, I am very happy with this employer and treats their consultants very professional and helps if & when needed.

    JUST CURIOUS, DO ALL THINK I CAN EXTRACT MY PAID 7K BACK FROM THIS EMPLOYER WHO CHEATED ME OR YOU THINK ITS WORTH LET IT GO???....any comments, suggestions are greatly appreciated!!

    The adv of 485 route compare to CP is EAD/AP/AC21. In CP, the applicant is getting immigrant visa in a foreign post/consulate. How can USCIS give EAD/AP for a person who is staying outside of US to grant EAD/AP?. There is no technical ground for this request. If you/IV want to lobby, lobby for EAD/AP for the guys whose 140 was approved and staying in US legally on a non-immigrant visa. This may be possible thro, USCIS regulation w/o law change.

    Though, law does not force any one to chose only 485 route, while you anyone already in US. Very very few guys will opt for CP while in US due to lot of hurdles in CP. Forget about retrogression, EAD, AP. Opting CP, cost you to fly to home country to get immigrant visa. There is no gurentee that US consulate will give you a immigrant visa based on approved 140 in CP process. That is always risk of denial at interview. It is something similar like, H1B approval by USCIS does not guartee the H1B visa at consulate.

    Quick question:

    If I file AC-21 Memo to USCIS and I got laid off from my previous job 14 days prior to 180days and started the new job 14 days prior to 180days and the petitioner employer will not revoke I-140, will that cause any issue?

    Do i have to show to USCIS that I started my new job after 180 days?

    No IV provision is in the bill.

    For something to happen, each member needs to do their part by supporting this effort and taking part in action items. With so little support and initiative we cannot expect to match the kind of hard work DREAM act advocates have done.

    If we need an amendment, we should be showing up for advocacy day or signing up for monthly contributions, volunteer our time, or doing any state chapter work by meeting local lawmaker offices regularly in groups. Dream Act folks have built a very strong network and advocacy effort that no politician can ignore. Go through the list of things they have been doing over the past few years and you can judge how much percentage we have as a community matched that effort. This is a reality and and ultimately it will be us that are responsible for no bill being passed in the last few years.

    The community needs to do more than wasting time on the forums and trackers if they really want any bill to happen.

    Definitely it is time to Unite. If they are doing illegal immigrants legal citizens, why should not legal applied immigrants as Green card holders.

    Do you think we need to start some thing like flower campaign or sending letters to president like that....

    But it is the time to act. Now or Never..........

    Another idea.. (this will require a small bunch of people only)

    Let a group of 10-25 people tie themselves on chainballs and handcuffs (or fetters) and march 1 mile to the USCIS office. Get this event covered by media..
    Hold banners like "Free us", "We want EAD", "i485 NOW" and raise a few slogans

    In addition someone can dress as Uncle Sam and pretend to whip the prisoners..

    - How has greencard changed your life after receiving it?

    It was a relief. No change on the work or personal side of life. Still at the same job. It pays well (always has) and I like it.

    - What did you do on the day you received it?

    Called my wife (who was in India). Bought a bottle of 'Blue Label' and polished it off in one night. Skipped the next day at work b'cos of the hangover.

    ** For people who wonder what happens if your GC is approved when you are in India. My wife was in India when our GC was approved. I did not mail her the GC. She entered US using Advance Parole. At the POE, she was asked if she was aware that her GC was approved. She did say "yes" and she was welcomed into US without any hassles.

    - How did the long wait upset your life?

    The wait was long (PD : May 2002 , GC AD : June 2007). The initial stage (2002 to 2004) was carefree (not worried about GC. More focussed on establishing career). The middle stage (2005 to 2006) was painful. We were in the I485 stage for almost 3 years. Then the final stage (2006 onwards) was carefree again. We had given up on the GC process and had decided that it will come when it has to come. We even bought a house in 2006 and decided to live life as we always wanted to. And then suddenly the GC arrived in June 2007 (interestingly there was no email .. nor any LUDs).

    The only frustrating thing in the I485 stage was the annual renewal for EAD, AP. Fortunately, my employer paid for all that (including spouse). But it was hassle to get the papers ready, fill in the forms, interact with the immigration department ..so on. This was a little irritating every year.


    - How did immigrationvoice help you during this long wait?

    The immigrationvoice leaders are very inspiring. It is very heartening to see everyone so excited and willing to stand up for a common cause. Of course, there are the occasional "wet towels" in the forums who want to see the negative in everything. But I have seen the IV leaders learn to ignore them.

    - Would you like to continue your support to immigration voice and help others waiting?

    Sure. We are hard pressed for time. But have contributed financially in the past (anonymously). We believe in doing a deed and not talking about it. (so please do not read more in the financial contribution part). We will continue to send in the few dollars as usual.

    - Any advice for everyone?

    It is very easy to say that do not let this process affect you. And we are not going to say it. It is like preaching to the choir.

    All we can say is "Hang in there". Plan for your future. Have your goals and work towards them. And we hope GC is just one of them.

    Senior (PD's from 2001-03) EB3-I sufferers, you'll surely get what you deserve by the middle of 2009. Having said that, if you think its in your best interest to get a better job under EB2, go for it and port your PD. Nothing can stop you.
    If someone writes a letter to USCIS to stop EB3 porting, you can counter it by writing another letter explaining why you are porting in the first place and you have the right and the freedom to get better jobs and qualify for higher categories.

    I agree with you. It's not required by law to file any AC21 papers so the USCIS cannot do much. Also, the green card cannot be revoked after 5 years so by the time you apply for citizenship, the USCIS cannot do anything bad to you. Worst case, they will ask about it during the citizenship interview so it's a good idea to keep your employment offer handy. But it's very unlikely and I really doubt they can deny your citizenship based on this. That's why I see no drawbacks in not filing AC21 and no benefits in filing it if you know that I-140 won't be withdrawn. My advice would be to take an employment letter from current employer and keep it in case the USCIS asks for it. There is no need to cause troubles for yourself by letting the USCIS know about it.

    Thanks for explaining this clearly. 2 Questions:

    1. If you use EAD and don't file AC21 and assume your I140 is revoked and USCIS wrongly denies I485 based on the I140 revocation, will you be on legal status while you fight the USCIS ?

    2. If you do file for AC21 and switch jobs, if you happen to change jobs again, do you have to file for AC21 again? Does this need to happen everytime one switches jobs?
