    Lets just say the announcement is that you can apply EAD/AP once your LC is cleared. Then just like usual USCIS will spend there time precocessing these new applicants and you will have to wait 1 yr just to get EAD/AP.

    USCIS would be better run by a bunch of drunken monkeys.

    Sad to see students being punished like this. They are just taking advantage of the system and make some money, but not doing anything illegal. That's what we are all here for right? Make some money. If enrolling for F1 and working somewhere else is against rules, then why did USCIS issue F1 and CPT to the students.

    Sorry all, i couldn't find video in english. But the video says it all.
    Chip locks which are normally used against terrorists and criminals are used
    on students of tri valley univeristy.

    It's a human rights, privacy issue at it's peak..

    It's heart breaking to see like this..

    There may be scam from students, university but it's also problem from consulate, USCIS etc.
    This is ridiculous..

    Get one thing done is better than spreading limited resources on multiple topics. To increase immigration quotas is not achievable before presidential election is done.

    Why not just focus on getting name check delay solved. It is under congress scrutiny already, all need are to add more oil to the fire.

    nobody is comparing the schools over here with IIT/IISC.
    There is a quota for masters in H1B.
    There should be a similar quota in GC for masters.

    what logic? did you vote for a senator that supports such a bill or are you planning to present it in the senate/house?

    and to your point, even i am not comparing any schools... i am just saying that there should be a quota for iim/iit grads...

    Guys,

    I am also in somewhat same situation. So thought of sharing it in this thread.
    I am also single and filed 485 in July 485. My PD is Dec 2006 under eb2. At present the EB2 dates are June 2006. I am carefuly waching the dates every month to pull back my application if my Eb2 dates becomes current to my PD date.

    But this question often hunts me...

    1. If USCICS apprvoes my 485 by mistake while my PD date is not current, can I let them know about it and get the 485 approval cancelled or is it irreversibale...??

    2. HOw long does it take to notify USICS to withdraw my 485...??

    0.0001% chance that your 485 will be approved when your PD is not current.
    Dont withdraw the 485, if you already found your spouse. Watch for visa bulliton and search the parter quickly. You will have 15 days time between visa bulliton publising date and the date on which PD is current. Within that 15 days you can get marry, and apply "follow to join" petition for your spouse.

    For those of you celebrating the defeat of Democrats because they sabotaged CIR due to the "path to citizenship" it's time to get real. Conservatives (both Dems and Repubs) are more than comfortable shutting the door to ALL immigrants. Don't fall into the trap of anti-immigrant legislators, don't let them turn this into a wedge issue.

    I agree with this 110%. Reps are more conservative. They don't want any non-american in this country. They would just say "GC or what.. Get the hell outta here".

    Turning on the undocumented is not what we want to show to the outside, it is a losing proposition and will turn off the public.

    As to what to do now, I'm puzzled. CIR is effectively dead in the US House, probably the Senate as well. The voters said loud and clear this week that they want the focus to be on JOBS not anything else like grandiose immigration legislation.

    What to do now? Looks like another 2 years tacked on to the wait from my perspective :/
    Another 2 years., and another year after and an year after... come on guys....

    This Is Good for every one , as People With Phd's and Masters degrees will be eliminated from 140K Cap ..which will defenetly double the number of green cards for EB3 ......hope this works

    I have 2 MS degrees from US Univs ... 4 years ...and a lot of $$$$$$ spent

    I have better suggestion. Find work in Detroit, MI . Bring your first wife on H4. Apply for Candian green card. Bring your second wife just across the border in Canada.

    In three years you second wife will get candian citizenship. She can then come to the USA on her own accord.

    I think all 3 of them (Husband & 2 wives) should apply for their own H1B's and make it here and then apply for separate GC's.

    Wish I could say something to help those who missed feel better. I was fortunate. My PERM (atlanta center which is another slow goer but nowhere like BECs) got approved on Aug 14. I filed aug 17 but don't think I submitted all needed docs due to unavailabilty of some. I saw some people at Atlanta center wait for much longer than PERM should take and they gave up. My heart goes out to everyone. We do need to become involved with IV...be it those who are ahead in the game, be those stuck in Atlanta PERM, be those stuck in BEC and/or coming out of it now. Each and every person must join so as to fix this broken immigration system. People are stuck in differnet stages and it's not fair, so do get involved and help IV in helping you.

    I am sorry i donot agree with your point of view

    Just imagine what will happen to the market flooded with EADs. Job market for H1Bs will totally be down. No US companies will hire H1Bs if they get somebody with an EAD. Tonnes of Junior developers and S/W testers will in the market driving the billing rates down even further. It's better to pack up and leave. I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.

    Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

    I am in a similar situation and have a very simple question. Can I port from EB3 to EB2, while on EAD? I do not have a valid H1. AFAIK porting needs re-filing a labor application, hence the confusion.

    but isnt this the reason for LC advertising? That is, if a USC or permanent resident applies he should be given preference over an immigrant. By that rationale I am not so sure it is illegal.
    Also, many large companies, when applying for jobs on their websites, mandatorily require you to state your visa status. While self-identification (race, sex) is always optional and cannot be required (by law, there will alwyas be a staement that says submission of this info is voluntary). t
    They cannot ask it if it is illegal, and clearly this information is used in the employment process.
    So, I am not so sure this is illegal.
    I am pretty sure that discriminating on nationality is illegal, but that is different

    Yes! An employer can chose not to sponsor a H1B and hire a USC or GC holder for various reasons (for examples companies dont hire H1b's for positions when they are laying off ). AFAIK, EEO doesnt consider a H1B applicant in the aspect you are talking. When EEO talks about National Origin, it is talking about any discrimination faced by you in case if you are denied a job given that you are Indian/Chinese/whatever.

    I may have to respectfully disagree with this.. Mine was approved on June 13th 2006 and my PD is current.. I have seen many EB2 with a later PD and 140 approval being approved.

    There is only ONE trend... that is NO TREND :p

    Your idea is marvelous, I totally agree, if not five years, make it eight or ten years but should have something like that. I don�t know how easy/hard is to get this implemented. But we could try for at least some relief once a person finishes a decade in this country.

    The best thing to ask for is a "time factor".

    Those are good points. We are not all Indian or Chinese on this website and in my case I moved to the US because of insecurity in my country (got kidnapped twice). If I went back there I could have a top job with a top company (and have had many offers) but that is not a place where I'd like to raise a family.

    Before the US I almost moved to China, but then I got the US job offer. I now have the Canada option, but I wouldn't mind moving to India. I have lots of Indian friends and I think Indians are easily one of the very nicest people in the world while being smart too (not conceited), plus they speak English. (Nothing against China, but it would take me at least 3 years to learns OK Chinese)

    Anyone have any advice about finding a job in India? (I am serious) I have to have options since my home country is not an option, and in case Canada doesn't work for me. If anyone can give me information on moving to India I would really appreciate it. Thanks!

    I think, your best bet would be Canada....I don't know your nationality, but Indian immigration laws are tough...work visas are not easy to get...

    Montreal is a great city! Very European and multi cultural...you can't avoid French influence, but you don't have to know French to survive...there are some great companies in Montreal...
