I am EB2 I with a priority date of April 2006 (Direct labor applied and approved from employer A, I 140 applied and approved from Employer A, Filed 485 from Employer A itself)
Moved to Employer B using EAD in 2009 January. (Almost after 18 months after getting EAD)
10/15/2009 i called the TSC and asked the representative to know whether my case is pre approved or not. the representative told me that he does not have any of that data and opening a SR will let us know. i opened one SR on the same day.
I got a mail just now, with the following text in it.
"The status of your request is
Your case is on hold because your appear to be inadmissible under the current law
Rather than denying your application based on inadmissibility, we are placing your case on hold while the Department of Homeland security considers additional exercises of the security of Homeland security discretionary exemption authority.
Such an exercise of the exemption authority might allow us to approve the case."
What does this mean, any one has some idea about it.

Hi,
Sent letters to WH and IV. Besides, I printed 100 copies of the original template and kept them in an Indian grocery store, with the permission from the store owner, although it took a long time to explain our situation to the owner of the shop.

I think this law puts an enormous burden on us to prove we are here legally. If for any reason we are stopped for speeding, the law allows the cop to ask us to prove we are here legally. technically, he is supposed to verify this with USCIS, but we know how efficient they are! Also the average cop probably has no idea what EAD/ Adjustment of status etc etc are and this can land us into trouble, atleast until we prove that we are here legally!.
Not only is legislative reform for legal immigrants held hostage by illegals and their lobbies, but actions directed against them are likely to entrap some of us into trouble with the law.

Everest Technology? Sounds so familiar, but definitely they are not in the list of blood suckers I dealt with.
There are thousands of bloodsuckers like this one, they know the Immigration law better than anybody else do, they will do anything to stop you from leaving their company.
BTW, you don�t need the copy of I-140 for using AC21 portability.
You might need a copy when you apply for a 3 years H1 extension, double check this with an attorney.
If I were you, I wouldn�t stick with this employer, I would definitely use AC21 after 180 days.

I too thought that it could be a hoax call. But When I discussed with my employer and came to know the name of the person who called me is same as that of person who visited our employer 2 months back, then I realized that it is not a hoax call.
But I really don't understand what was the purpose and why I got such call and why he did not show up. Till now there is no communication from the officer.

Receipts: 7/18.
No Finger printing notice received. This was at NSC. Mostly will get 2 years EAD as my PD is nowhere near to current but will update everyone for sure once I receive the cards!

I asked the officer if its the new requirement and she replied Yes, its started recently. If you are in H1 or H4 visa, you need to prove that you are still in job and getting paid. One more nail in the coffin.

Its a small good news. I got similar status update last year sometime in Aug/Sept before my I-485 was finally approved around end of Sept '08. My case was originally filed at CSC and then was transferred to NSC. I got this message when NSC finally picked up my transferred case, dusted it off and (I'm guessing) input it in their system. Most likely your cases went the similar route and now they have been finally picked up by the destination center for processing.

I personally think Mr. MPADAPA's assumption is wrong. Last year (2008), the spillover came from Family quota of 2008. Spillover from Family or Employment quota of a particular year cannot be given to the following year. So the fact that there is nothing left from the family quota of 2008 doesn't change any situation here.
So, this year the spillover that Employment category can get from Family quota will be the unused numbers of 2009 Family quota.
This is just my thought!

Kudos to USCIS :D But it comes with a price for EB folks. For the past few years, forward movement of PD during the last months of the FY has been propelled due to the spillover of unused FB visa's from prior year. Remember last year almost 23k FB visas got spilled over to the EB limit and caused significant forward movement of PD's for EB2 I/C. Unfortunately in 2008 USCIS used up all of the FB visa's, hence there will be no visa's to spillover:mad: I had consolidated the visa usages in the past few years, Here is a link to the document (http://spreadsheets.google.com/ccc?key=p_liYSUcqZRXA9OjuWUNRag&hl=en). The document has hyper link to the source for all the data.
If you are EB3 I/C and wondering why dates didn't move in 2008. Here is the answer,

If you are EB2 I/C and dreaming that somehow the new spillover would take care of things. You might be pleasantly surprised by the usage of EB1 and EB2-ROW in 2008. Last year many were dreaming that all of the 23K FB visa's would directly go to EB2-I/C but the data shows otherwise. EB2-C and EB-I got 6,967 and 14,819 visa's respectively for the entire 2008. If all the 23K visa's were used by EB2-I/C then their respective numbers would have been much higher.
Bottom line: Without significant change in the EB limit through recapture or increase in EB limit. The forward movement of PD will be a trickle atleast for the rest of the year. We can pray and do whatever before every bulletins, but the numbers cannot lie and hence the bulletins would be a disappointment (for many) until we grasp the reality.
Let us get our acts together and start working together towards some constructive actions like a bill or an amendment. Let us have a healthy debate on what needs to be done.

I had been lived in Toronto for last 4 years.
Frankly speaking, Toronto is a very good city. I feel it probably can match up with Chicago, or 50% of NYC.
Multi-culture is even more obvious than in NYC.
But keep in mind that there are less high buildings than some super citys like NYC.
When talking about job opportunity, it is better to compare city with city, not country with country because actually once you settled down in one place, you probably can not go hunting jobs in another side of country.
So, the job opportunity # in GTA (Great Toronto Area) is about 75% of Chicago or 1/3 of NYC.
Many people told stories about immigrants can not find job in Canada. That is not true. The truth is that most of immigrants go from USA get job within half year even in 2001. I admit that some immigrants go direct from their homeland do have hard time to get job in Canada because of lacking English communication ability and North America work experience. For people who have been worked in USA for some time, finding a job in Canada is almost guaranteed.
The thing I don't like in Canada is that the workload is light and business is quite slow. So many lazy colleagues and from time to time union threaten to strike (for raise salary). Lots of our taxes are wasted for this huge government's unnecessary spending.
As of discrimination, I don't think there is too much. I feel there is some, but not very obvious. Part of the reason I think is because lots of immigrants actually live better than average traditional Canadian. It is true that many local teenth only finish high school and enjoy work as labor. You could say that is jealous.
Good Luck & enjoy life in Canada.

So let me guess, your parent applied under 245(i) in 2001 and thats why you have aged out. No thanks, that 245(i) amnesty has caused us enough problems with the labor certification backlogs.

Also, It is a big concern for me when when some EB visa holder's kid age out and is left out of the process. If someone can show me that this so called dream act will help in that, i will support it and do my part.
