Wrong !! I work for IBM and IBM just recently outsourced almost all the PM's and SDM's job to India only ( Not to China because of English speaking ability ). IBM got tonnes of skilled MBA's with english speaking. As of now hardly I see any PM's from US during calls. But I admire you for all the other points. well said.

Many of the Indian, Chinese, Korean and other people from Asian countries have a very strong accent with their English communication....which can become a hinderance in getting the top job. Also note that a PMP will get a job if he is technically qualified and has a PMP, however for the top jobs your soft skills like communication, people skills and networking takes precedence.

I'm posting this here since the old volunteer forums are no longer available. Where all have you posted flyers, info in CA?
For those in the Bay Area: Have you contacted the new Indian Community Center in http://indiacc.org/Default.aspx (they have locations in Milpitas and Sunnyvale)? I don't live in the South Bay, but it seems like this is a pretty active space. Wonder if they would let us give a talk, and/or post flyers etc. If no one has been in touch with them, I could try.

Hey Bozo - I've been following IV for about 2 years now using my spouse's ID - I just created one for myself today - My wife and I have contributed to IV also. Know the facts before shooting your mouth off - NUT JOB!!!
Why not to use that very same ID you have been using for 2 years to post this one also? That way others will know you have been a member and also contributed in the past. No confusion and peace.

The anchor started off the interview by making a reference to "hi tech workers" and that some of these folks were in the British terror plot !! "Why are you filing the lawsuit when your client can apply for the GC in Oct?" !!Anyway, the attorney was quite articulate in explaining the issue. Guess who followed the attorney ... Rep Tom Tancredo who called this a "minor inconvenience" before stating he wants all immigration to be halted!!

You mean to say that "Those who have EAD with PD 2006/2007" needs green Card and you dont bother about PD 2000-2005 from Backlog who never got a chance to apply i-485 ?
Moral: Allow the people to suffer who are suffering and let others make merry(PD 2006-2007).
I am just giving my observations. I (and most of the people here) know the pain in waiting on H1-B. Definitely the ability to file I 485 desrves higher priority.

You cannot combine work and education for EB2 and for EB3 it must be so noted on the Labor Cert.

Education evaluation was not done for bachelors because the Labor only required masters. My attorney is planning to use 2 years of my experience to compensate for the additional 1 year of bachelors degree

I am also in somewhat same situation. So thought of sharing it in this thread.
I am also single and filed 485 in July 485. My PD is Dec 2006 under eb2. At present the EB2 dates are June 2006. I am carefuly waching the dates every month to pull back my application if my Eb2 dates becomes current to my PD date.
But this question often hunts me...
1. If USCICS apprvoes my 485 by mistake while my PD date is not current, can I let them know about it and get the 485 approval cancelled or is it irreversibale...??
2. HOw long does it take to notify USICS to withdraw my 485...??

Dont withdraw the 485, if you already found your spouse. Watch for visa bulliton and search the parter quickly. You will have 15 days time between visa bulliton publising date and the date on which PD is current. Within that 15 days you can get marry, and apply "follow to join" petition for your spouse.

Sorry to hear the screw up. I had some what similar issue with H1B extension when attorney didn't timely file my application. USCIS approved H1B with no I-94 attached basically asking to leave country and get stamping in India.
We then contacted Murthy firm who filed 'nunc-pro-tunk' petition saying it was a mistake by employer/attorney and I shouldn't be penalized. USCIS then issued new approval with I-94.
I am not sure if this works for 485 but a competent attorney should be able to give a conclusive answer. Since you have the document you should try this and also change the attorney at the same time. You can also get a statement from old attorney about his mistake.

Arent you concerned that if its approved on Oct 1, and you didnt get it, then where is it? Did you ask them as to why you havent gotten it in mail even though it has been approved a month ago? Also, did you check with your lawyer if he got anything?
It was approved on 10/1*/2007 not exactly on 10/1/2007. I was concerned and I asked her. What she told me is that once case is approved it generally takes around one week to get that mail out from mailroom and once it is out of mail room then generally it takes 2 weeks to get the mail for you. So calculating that I thought I should get that within a day or two. ANd another thing she told me is that once mail is out from USCIS mailroom then USCIS does not have any control or tracking mechanism so I do not have any choice other than waiting for mail...And yes I have just shooted an email to my lawyer. What do you advise?

I think he posts spicy messages on his forum to market himself. He uses strong language against USCIS to gain support from his prospective clients.
Has he ever stood up for immigrants other than writing strong worded posts? Give me examples as I do not know any? I may be wrong in my assumption.

the title of this thread is "Ron Gotcher's take on VB." Its what he thinks on a forum hosted by him.
a lot of these lawyers post "spicy messages." Its marketing in the 21st Century. He did not say that its grounds for a lawsuit, a reader of his forum asked him the question and he said he didnt know and the july bulletin would clarify things.
A majority of the attorneys dont do anything for the EB community. the few that do attend rallies or do the ask questions type of conference call arent really serving the community. They are doing the same thing that Gotcher is doing. I am not defending him by any means. i myself had issues with some of his posts that I feel were directed at getting more traffic to his website, but this thread was about his impression about the july bulletin. With the lack of interest at predicting VBs, this is at least something to discuss.

I applied in NSC 485/EAD/AP on July 27th. The case was transfered to CSC. 485 Application was then transfered to TSC from CSC but EAD and AP are being processed in CSC.

I have a three year bachelor degree + MBA from India with 9 years of experience. My labor was filed requiring Masters degree + 3 year experience with no mention of bachelors degree. Last week, I received I-140 decline (I-140 filed under EB2) citing that my bachelors degree is only three years.
My company is planning to file an MTR with appeal citing 1) My labor only required Masters degree with three years experience and that I have the Masters degree with three years 2) I have bachelors degree equivalent with 3 year bachelors degree and 2 year experience equated to 1 year education equating to US 4 year bachelors degree.
Do you think my appeal would have a chance of success? Please let me know your opinion. I have to file an appeal in next few days. Thanks for your help.
