#2 Oct 2001 - Change employers and get a H1 transfer (California) New I-94 valid till Feb 2004
#3 Nov 2002 - Fall in love with an American girl
#4 Dec 2002 - Quit job and move to Michigan to be with girlfriend (Out of status)
#5 March 2003 - Find job in MI, employers lawyer botches my H1 transfer / extension (Out of status)
#6 October 2003 - Fall out with employer and quit.
#7 November 2003 - Marry girlfriend (Out of status)
#8 April 2004 - Wife files I-130/I-485/I-765 (AOS Pending status)
#9 April 2004 - Find a new employer "X" and start working for him
#10 June 2004 - Wife and I have irreconcilable differences and I separate, later file for divorce
#11 June 2004 - "X" petitions for new H1B for me for FY-2005 starting in Oct.
#12 July 2004 - leave US and go back to homeland, get new H1 visa stamped with expiration date of June 2007
#13 Sept. 2004 - Come back to the US with new H1 visa stamp and get new I-94 (exp. June 2007) -----> Fresh start, eh ?

#19 June 2006 - EB2 I-140 filed with copy of labor (Still pending) Obtained receipt
#20 Oct 2006 - EB3 labor approved from backlog center
#21 May 2007 - File for 7th year H1B extension
#22 Jun 2007 - EB3 I-140 filed (Still pending). Obtained receipt
#23 Jul 2007 - H1B Extension approved (new I-94 with expiration of Jun 2008)
#24 Jul 2007 - Ready to file I-485 concurrent with EB3 I-140
From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.
UN from what I read he was out of status from Mar 2003 to Apr 2004. Pls correct me if I am wrong

Lawsuits and fighting is against IVs core principles. IV is a support network for us who want to positively work for a cause by lobbbying, awareness, bringing people together so that our voices are collectively heard.
If you do not want to do what IV does, you can open your own website and do what you want - you can gather people who think like you and you can proceed with your agenda

Yes, you may end up blocking strive act, but what will happen then is all your jobs are going to start disappearing to eastern europe, China, India and any other place possible. I don't know if you work in high skilled labor market but if you do, I am sure you must have noticed the large number of engineers, doctors, architects who are immigrants and contributing to this society. Anyway, I think discussing this point with you is pointless.
Anyways, you are welcome on this forum. You can express your opinion as much as you want. I don't think we (or you for that matter) are going to gain anything by arguing online. 3. Whatever beating/scolding she has done to your child, it is past. Children are much resilient and recover easily and faster than we adults in case of physical and mental suppression.
4. See, if your parents can come for few months to support you.
5. Send your child to a good day care or hire a recommended nanny from a referral.
Not all nannies are bad. And next time, hire a nanny in a legal manner.

This thread starts with a call to all the EB2 people. Is it only the EB2 people suffering due to USCIS actions? Or are EB2 applicants a distinguised lot that they dont want EB3 to join with them?
It is so depressing to see the attitude of some of these guys !!! There have been so many threads explaining the difference(or indifference) between the qualifications of the applicants.
The suffering has been equally bad or even much worse for the EB3 applicants. I am an EB3 2003 applicant and my suffering has been equally painful. The campaign should be about fair treatment to every applicant, not alone EB2 or EB3.
Any campaign will only be successful when we try to do something together.
If you yourself are belittling the EB3 applicants, why do you have higher expectations from the American Citizens/Government.

We are trying to address a specific issue, which is about blocking approvals when dates are current, and for that, we are using this current fiasco as an example. The USCIS memo specifically talks about EB2 india, china applicants on hold. Since EB3 was listed as U, we cannot do anything about it. If both EB2 and EB3 were current, I would have given a call to both. There is no belittling out here. the Circumstances are like that.
EB2 and EB3 are working together in the visa re-cpature.
This is a separate issue, but will be useful when visa re-capture is successful.

Not everybody is afraid of sending flowers. I think you might end up getting a 2 min coverage from one channel nothing more. I find this whole thing pointless. You can yell and scream but you asked for my opinion.
Guys, any reason why we have a whopping 70% of the members not interested in contributing to this idea??
There is nothing illegal or offensive in a humble protest, so why the lack of interest?? Are you worried that you'll be pulled up for a humble protest?
It's not even that expensive to send a bunch of flowers. We have to come together and do something here to implore the USCIS to reform the immigration process. Just lurking around , and not doing anything about this is not going to bring about any reforms to this dysfunctional system.
I would love to know the rationale behind your lack of interest. Appreciate if you can speak up as to why you wouldn't want to join in. Atleast let us know if you have a better idea. Doing nothing and playing the wait-and-see game is probably the worst option.
