Hi all,
I graduated this June and started working in a company on my OPT status (valid July 2009 to July 2010) since July until now. In October, my company filed H-1B petition, and on Nov 24, we got approval notice I-797B (without I-94) instead of I-797A, as well as a DENIAL of concurrent change of status.
Shortly after we filed the petition, I took a short trip to my home country and then come back(with OPT status) on Nov 1.
In the notice, it states "...the beneficiary departed the US on Oct. 15 2009, thereby abandoning the requested change of status. As such, the beneficiary has failed to maintain his F-1 status. Accordingly, the concurrent request for change of nonimmigrant status is denied."
I am really confused here because I re-entered the US with my F-1 OPT status on Nov. 1 without any issue.
What should I do now in order to get my H-1B visa? Am I still maintaining F-1 status (legally staying in the US) even if it stated that I have failed to??

Why do you think that will happen..
I am guessing that if you 140 is approved (which is company based), then you are good because 485 is based entirely on the applicant..

Your situation isn't too tough.
Yes you will need a new F1 visa to re-enter. Nobody knows your chances of rejection, just take all the docs and hope for the best.
If your F1 gets rejected then you can come back on valid H4 - I don't think they will cancel other valid visas. However once you are back here you'll have to again apply for a COS to

Below are the 2 listed jobs.. I am currently working as 15-1051.00 Computer Systems Analysts for XXX comp... I have been working for more than 3 years.. They are planning to file my GC soon..
I know for a fact that you cannot count current employer exp for GC. If i start working for the same employer on 15-1031.00 Computer Software Engineers, Applications , is it more than 50% different in role so i can count my 3 years experience when applying my GC ??
Also do i have to file a new H1 for this 15-1031.00 Computer Software Engineers, Applications job from same employer ??
All Attorney/ Senior memeber.. please guide me on this..

i did the same... selected 485 only, i asked the lady who checked ID she said that was ok...
also if you think about it the FP notice was for 485, if EAD or AP requires FP we should get separate FP notices init? :) (thats my take on it)

The name provided for my Passport and all other documents is "Rajendra Upadhya Kumbhasi" but in my Birth Certificate they have included my father's name along with my name i.e. my Birth Certificate has "Rajendra Murlidhar Upadhya Kumbhasi". I would like to know if this could be a issue and if so will a affidavit help me resolve this issue.
Please let me know.

the change in salary ($76K to 120K) is a cause for concern. It depends how long ago you filed your labor. If it has been greater than 5 years, IMO the salary change may be ok. Rather than the titles, the job duties have to reasonably match.
